Apex Fitness Coaching – Terms & Conditions

These Terms & Conditions apply to all coaching services provided by Apex Fitness Coaching ("Apex Fitness", "we", "us", "our") by Sean Fraser, including 1‑1 Personal Training, Hybrid Coaching, and Online Coaching. By purchasing, booking, or participating in any service, you agree to the following terms.
1. Services Provided
Apex Fitness Coaching provides personalised fitness, nutrition, and lifestyle coaching services, which may include:
- In‑person personal training sessions
- Online coaching via training apps/platforms
- Hybrid coaching (combination of in‑person and online support)
- Exercise programming, nutritional guidance, and accountability support
Services are for educational and coaching purposes only and do not replace medical advice.
2. Eligibility & Health Disclosure
You confirm that:
- You are medically fit to participate in physical exercise
- You have disclosed all relevant medical conditions, injuries, medications, or limitations prior to starting
- You will update Apex Fitness immediately if your health status changes
Apex Fitness reserves the right to refuse or pause services if participation is deemed unsafe.
3. Bookings & Sessions (1‑1 & Hybrid)
- Sessions must be booked in advance and are subject to availability
- All sessions take place at the agreed location (e.g. JD Gyms Glasgow South or other agreed venue)
- Sessions are non‑transferable
Late Arrivals
- Sessions will end at the scheduled time regardless of late arrival
- Full session fees still apply
4. Cancellations & No‑Shows
1‑1 & Hybrid Coaching
- A minimum of 24 hours’ notice is required to cancel or reschedule a session
- Late cancellations or no‑shows will result in the session being forfeited
- Exceptions may be made at Apex Fitness’ discretion in genuine emergencies
Online Coaching
- Once a coaching period has started, it is non‑refundable
5. Payments & Fees
- All payments must be made in advance
- Prices are displayed in GBP (£)
- Payment plans (monthly or fixed‑term) must be honoured in full
Failure to make payment may result in:
- Suspension of coaching services
- Termination of the agreement
6. Fixed‑Term & Monthly Agreements
Fixed‑Term Coaching (e.g. 3 Month blocks)
- Non‑refundable once started
- Early termination does not entitle you to a refund
Monthly Rolling Coaching
- Requires 30 days’ written notice to cancel
- Notice must be submitted via email or written message
7. Refund Policy
- All services are non‑refundable, including missed sessions
- Results are not guaranteed, as outcomes depend on individual effort, consistency, and adherence
8. Client Responsibilities
You agree to:
- Follow training and nutrition guidance responsibly
- Use proper form and stop exercise if pain or dizziness occurs
- Communicate honestly and consistently
- Take full responsibility for your actions outside coached sessions
9. Results Disclaimer
Apex Fitness makes no guarantees regarding fat loss, strength gains, or physical changes. Testimonials and results shown are not typical and depend on individual effort and circumstances.
10. Injury & Liability Waiver
You acknowledge that:
- Physical training carries inherent risk
- You voluntarily assume all risks associated with participation
Apex Fitness Coaching, its coach, and affiliates shall not be liable for:
- Injury, illness, or death
- Loss or damage to personal property
Except where liability cannot be excluded by UK law.
11. Nutrition Guidance Disclaimer
Any nutritional advice provided:
- Is for general guidance only
- Does not constitute medical or dietary prescription
- Should not override advice from a GP, dietitian, or medical professional
12. Online Coaching Specific Terms
- Programmes and materials are for personal use only
- Sharing, reselling, or distributing content is prohibited
- Access to platforms may be revoked if payments lapse
13. Suspension or Termination by Apex Fitness
Apex Fitness reserves the right to suspend or terminate coaching without refund if:
- Abusive or inappropriate behaviour occurs
- Terms are breached
- Non‑payment persists
14. Media & Content Usage
You grant Apex Fitness permission to:
- Use progress photos, videos, and testimonials for marketing
This consent can be withdrawn in writing at any time.
15. Data Protection
Your data will be handled in accordance with UK GDPR regulations. Information is stored securely and never sold to third parties.
16. Amendments
Apex Fitness reserves the right to update these Terms & Conditions at any time. Continued participation constitutes acceptance of updated terms.
17. Governing Law
These Terms & Conditions are governed by the laws of Scotland / United Kingdom.
